Terms of Service
1. Provider and scope
MealWise is provided by Johanna Hoppe, operating MealWise, Baccumer Str. 19, 49808 Lingen (Ems), Germany. Email and telephone details appear in the Imprint. These terms govern the MealWise iOS app, MealWise account and related online services. The website’s freely accessible editorial content can be used without an account. Apple’s applicable App Store terms and the Apple standard licensed-application agreement supplement these terms for download, licensing and in-app purchases.
2. Contract formation and availability
The marketing website does not itself conclude a paid subscription. A paid subscription is formed only through the Apple purchase flow after the user selects an offer and Apple confirms the transaction. The App Store purchase sheet shows the binding product, duration, localized total price, taxes where applicable, trial or introductory offer, and renewal terms before purchase. The free account service begins when account registration is completed and MealWise accepts the registration. The app currently requires a compatible iPhone with iOS 18.6 or later, an internet connection for authentication and AI generation, and an Apple Account for purchases.
3. Service
MealWise generates recipe suggestions from natural-language requests. Depending on the selected plan and release status, it can provide ingredient quantities, preparation steps, estimated prices, estimated nutrition, local saving, refinement, regeneration and optional cross-device cloud sync. MealWise does not sell food, provide live retailer prices or promise grocery availability. Features marked as pre-release, closed testing or unavailable in the app are not part of the public service until activated.
4. Eligibility, accounts and territories
Users must be at least 16 years old. A user below the age of legal majority must have any parent or guardian approval required by applicable law, particularly for a paid subscription. Users must provide accurate registration information, protect access to their email, Apple and Google accounts, and never share one-time codes. Automated or fraudulent registration and attempts to bypass plan, entitlement, quota or security controls are prohibited. Availability in an Apple storefront is technical availability, not a promise that every feature is legally available in every country.
5. AI, nutrition, allergy and food safety
All generated recipes, prices, quantities and nutrition values are estimates. AI output can be incomplete, unsuitable, inconsistent or wrong. Before buying, preparing or consuming food, users must independently verify ingredient labels, allergens, dietary restrictions, quantities, cross-contamination, storage, hygiene, safe temperatures, cooking time and doneness against current authoritative advice and the actual product used. MealWise is recipe inspiration and planning support, not medical, nutritional, allergy, diagnosis, treatment or emergency advice. Users with allergies, medical conditions, pregnancy-related needs or prescribed diets should consult a qualified professional.
6. Plans, quotas and fair use
The intended public plans are Free with 15 initial recipe generations per calendar month, Basic with 80, and Pro without a monthly product quota, subject to fair use, security, duplicate-request and capacity protections. Basic and Pro include per-serving nutrition estimates when an estimate is available. Refinement and regeneration require Pro. Optional cloud sync is a Pro feature only when it is shown as available in the app. The same recipe model quality is intended for every plan. The current private-test Free allowance can be higher and is not a public-plan promise. The purchase screen and App Store product metadata control the paid offer presented to a user.
7. Auto-renewable subscriptions
Basic and Pro may be offered monthly or yearly through Apple. Payment is charged to the user’s Apple Account after confirmation. The subscription renews automatically for the selected period unless cancelled in Apple’s subscription settings no later than required by Apple before the current period ends. Apple and RevenueCat determine entitlement timing, upgrades, downgrades, billing retry, expiry and refunds. “Restore Purchases” is available in the app. Deleting MealWise or a MealWise account does not cancel an Apple subscription. Statutory consumer rights, including any mandatory withdrawal, refund, price-change and warranty rights, remain unaffected and may also be asserted against the party responsible under applicable law.
8. Trial and introductory offers
No trial is promised unless Apple displays one for the selected account and product. If an offer exists, the purchase screen shows its duration, eligibility, post-offer price and renewal period before purchase. An offer converts to the displayed paid subscription unless cancelled under Apple’s rules before the offer ends.
9. Optional cloud sync
Eligible Pro users can enable cloud sync only when the feature is activated and presented in the app. Local storage remains the primary copy. If Pro ends, cloud copies become read-only for 30 days and are then scheduled for deletion unless Pro is restored. Users can request deletion of cloud copies separately without deleting local recipes. Deletion can propagate across signed-in devices and cannot be reversed by MealWise after completion. The feature must not be publicly activated until its automated retention and deletion lifecycle has passed release acceptance.
10. User content
Users retain rights they hold in submitted requests. They grant MealWise and the processors identified in the Privacy Policy a non-exclusive, worldwide, limited right to transmit, reproduce and technically process that content only as needed to provide, secure and troubleshoot the requested service and comply with law. Users must not submit unlawful content, personal data about others without a lawful reason, confidential credentials, or content they do not have the right to use. MealWise does not claim ownership of a user’s request.
11. Acceptable use
Users must not attack, scrape, reverse engineer protected service interfaces, overload or disrupt the service; bypass authentication, payment, quota, fair-use or rate controls; access another person’s data; upload malware; automate abusive volumes; use generated content for unlawful harm; or probe protected infrastructure without prior written authorization. MealWise may proportionately block requests or suspend an account where reasonably necessary to protect security, users, provider capacity or legal obligations. Mandatory notice, remedy and consumer rights remain unaffected.
12. Availability, maintenance and updates
Internet, Apple, AI and other provider failures can cause delay or downtime. MealWise may maintain and correct the service. For paid digital services, MealWise will provide updates, including security updates, required to maintain conformity for the applicable supply period and inform users as required by § 327f BGB. Users remain responsible for installing available iOS and app updates after receiving appropriate information about them.
13. Changes to the digital service
MealWise may change a continuously supplied digital service beyond necessary maintenance only where these terms permit it for a valid reason, the change creates no additional cost for the user, and the user is informed clearly. Valid reasons can include security, legal or provider requirements, prevention of abuse, adaptation to operating-system or model changes, and improvement of existing functions. If a change materially impairs access or use, MealWise will provide advance information on a durable medium and the remedies required by § 327r BGB. This clause does not limit mandatory rights.
14. Account deletion and termination
Users can initiate account deletion in the app after fresh email-code verification. The flow removes associated MealWise backend records and requests deletion from connected RevenueCat and cloud-sync systems as described in the Privacy Policy. Local data is removed from the active app container when the app clears it or the user removes app data. MealWise may terminate for a material uncured breach, serious abuse, security necessity or legal obligation, subject to applicable notice and consumer protections. Account deletion does not cancel Apple billing.
15. Intellectual property and third parties
The MealWise app, website, brand, original interface, editorial content, documentation and backend code are protected by applicable intellectual-property law. The limited app licence is governed by these terms and Apple’s applicable licence terms. Third-party names and marks remain the property of their owners. Comparison pages do not imply affiliation or endorsement and must be read with their stated source date.
16. Statutory conformity and remedies
Mandatory statutory rights for digital products remain fully applicable, including rights concerning supply, conformity, updates, cure, price reduction, termination and damages under §§ 327 et seq. BGB where applicable. Nothing in these terms is a guarantee of a particular recipe outcome, but mandatory product and service obligations are not excluded.
17. Liability
MealWise has unlimited liability for intent and gross negligence; injury to life, body or health; liability under the Product Liability Act; fraudulently concealed defects; and any guarantee expressly assumed. For slight negligence, MealWise is liable only for breach of an essential contractual duty whose performance makes proper performance possible and on which the user may ordinarily rely; in that case liability is limited to the foreseeable damage typical for the contract. Mandatory consumer liability remains unaffected. Users remain responsible for the food-safety checks in section 5. This liability wording requires qualified review before public launch.
18. Governing law and venue
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not remove mandatory protections of the country in which they habitually reside. No exclusive venue is imposed on consumers. A venue agreement applies only where legally permitted, for example for merchants or a party without a general venue in Germany.
19. Consumer dispute resolution
MealWise is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration body. The business employed no more than ten people at the relevant reporting date and is exempt from the information duty in § 36(1)(1) VSBG under § 36(3) VSBG; this voluntary statement is provided for clarity. The former EU Online Dispute Resolution platform was discontinued on 20 July 2025 and is not linked.
20. Changes to these terms
Changes apply prospectively. Material changes affecting an ongoing paid service will be communicated on a durable medium with the notice and remedies required by law. Continued use alone will not waive mandatory rights. The version date above identifies the applicable terms.
21. Severability and contact
If a clause is invalid, statutory law applies in its place; the remaining clauses continue only to the extent permitted by the law governing standard consumer terms. Questions can be sent to mealwise-support@withoutcookies.dedyn.io.
22. Release review and sources
These terms reflect the repository’s implemented and closed-test behavior as of the version date. Provider/territory facts, final storefront metadata and the marked liability clause still require qualified legal review before public launch. This is not a guarantee against complaints or liability.
